This is How You Know the Insurance Company Isn’t on Your Side

So you’ve decided that you want to negotiate your accident case settlement on your own. That isn’t a good idea for a number of reasons, but for now, let’s assume that’s the route you want to take.
The adjuster for the insurance company that is speaking with you about your accident seems kind, caring, and says that he or she genuinely wants to compensate you in full. But on the other hand, this is the insurance company from the other person–the negligent person business or driver–and thus, you have your suspicions about how genuine the insurance company actually is.
Here are some ways that you can tell that the insurance company is looking out for themselves–and trying to save themselves from having to pay you–instead of genuinely trying to compensate you for your injuries.
Heavy Pressure
Any type of pressure to get you to settle now, is the #1 sign that an insurance company is trying to cheat you. They will say things like “let us pay for your first doctor’s visit,” or “we can give you $1,000 to help you with your lost wages.” These kinds of comments sound innocent, even helpful–but they’re disguised attempts to get you to settle your case too early and for too little compensation.
Asking for Prior Medical Records or Blanket Authorizations
When insurance companies start asking for all of your medical records from the last ten years regardless of whether they are related to the accident or not, they’re trying to fish for reasons to deny paying you. They will ask you to sign a blanket medical authorization and then pretend that “it’s necessary to evaluate your claim,” but in truth–the information they get will be used against you.
Minimizing Pain and Suffering
Insurance companies will make your non-economic damages, things like pain, suffering, sadness, loss of quality of life or PTSD, as insignificant. They’ll say that they have no value, or that the law doesn’t give much for those things. They may ask for “proof,” which of course, you may not have because medical records won’t show sadness or depression after an accident.
Downplaying these types of damages is one way you can tell the insurance company is trying to cheat you.
You Waited Too Long
The fact that you “waited too long” to get medical treatment or saying that your pain didn’t show up and hurt you immediately after an accident, are common tactics. They’ll use these to make it sound like your injuries aren’t severe, or even related to your accident at all.
These arguments make sense to many people who are unfamiliar with what happens to the body after injuries and who didn’t realize that these things are quite common, and normal after an accident.
